Germany's parental-leave stack is generous — if you claim it in the right order

Mutterschutz protects the mother and her income around birth. Elternzeit protects the JOB for up to three years. Elterngeld replaces the INCOME for up to 14 months. Three different laws, three different applications, one timeline.

After the birth the employment ban is absolute. Before it, the mother may choose to keep working — the employer may not demand it.

Mutterschutz — the protected window

  • Protection period: 6 weeks before the due date + 8 weeks after birth (12 after for premature births, multiples, or a child with disability).
  • Money: GKV-insured employees get Mutterschaftsgeld — max 13 €/calendar day from the Krankenkasse — and the employer tops it up to your full average net wage (Arbeitgeberzuschuss, refunded to the employer via the U2 levy). Privately insured mothers get a one-time payment of up to 210 € from the Bundesamt für Soziale Sicherung instead.
  • Dismissal protection: from pregnancy until 4 months after birth (MuSchG §17), dismissal is essentially barred.
  • The Mutterschaftsgeld weeks count against Elterngeld months — the mother's Elterngeld clock effectively starts at birth.

Tell your employer about the pregnancy in writing once you're ready — Mutterschutz protections (working-conditions rules, dismissal protection, paid Untersuchung time) only bite once the employer knows.

Elternzeit — the job protection

Elternzeit is unpaid leave from your job of up to 3 years per child (up to 24 months usable between the 3rd and 8th birthday), available to each parent, with a legal right to return to an equivalent job. During Elternzeit you may work part-time up to 32 h/week — and in companies over 15 employees you generally have a claim to part-time.

  • Deadline: register in writing with your employer at least 7 weeks before it starts (13 weeks for the slice between the 3rd and 8th birthday).
  • Dismissal protection runs from the registration (at the earliest 8 weeks before the start) through the whole Elternzeit.
  • Elternzeit is between you and your employer; Elterngeld is between you and the Elterngeldstelle. You almost always take them together, but they are separate applications.

ElterngeldPlus halves the monthly rate for double the months — the better deal when you work part-time (24–32 h/week) during the leave. The income cap for births from 1 April 2025 is 175,000 € taxable household income in the year before birth. Blue Card and §18a/§18b holders qualify; some short-term and student titles don't (§1(7) BEEG).

The paperwork timeline

  1. Pregnancy confirmed

    Krankenkasse and employer informed; due date certificate (Mutterpass) starts the Mutterschutz math.

  2. 7+ weeks before Elternzeit

    usually ~week 32 of pregnancy

    Written Elternzeit registration to the employer (both parents, each for their own months).

  3. ~Week 34 of pregnancy

    6 weeks before due date

    Mutterschutz begins; apply for Mutterschaftsgeld at your Krankenkasse.

  4. After the birth

    first weeks

    Birth certificate → Elterngeld application (many Länder online), Kindergeld at the Familienkasse, child onto your free GKV family insurance.

  5. Month 12–14
